霸王餐，泛指在餐厅或小吃店中，用餐而故意不付钱的行为，又称为白吃白喝。

• 属于诈欺之理论

用餐不付钱，是以错误付款的意思表示的消息（诈术）使之陷入错误（上当），非法取得用餐不付钱的利益，故属诈欺。若以虚伪客观外在事实（如：佯称朋友会帮忙付帐），更属于诈欺。

• 不属于诈欺之理论

用餐不属于付款的意思表示，更不是付帐的承诺，而付款意思是内心主观时常改变的想法，因此没有错误的消息（诈术），就算因此取得用餐不付钱的利益，也纯属民事不当得利、或债务不履行的问题而已。
