拟制(英语:Fiction德语:Fiktion)系使法律能对生活关系有合理的规范,依据法律政策,将特定事实确定,而不考虑真实为何,在法条文本中,拟制以「视为」表示;由于拟制为法律政策上的一种拟定,并以立法手段将法律适用的价值判断决定生活关系中的事实,故不容许举反证加以推翻,此与推定不同。

A legal fiction is a fact assumed or created by courts which is then used in order to apply a legal rule. Typically, a legal fiction allows the court to ignore a fact that would prevent it from exercising its jurisdiction, by simply assuming that the fact is different. This is the case with the so-called Bill of Middlesex where the Court of King's Bench could only exercise jurisdiction over cases which took place in Middlesex. To allow the Court, which was the central court of the land, to take jurisdiction over other cases, parties began to plead that, along with the other facts, there had also been a trespass which occurred in Middlesex. This allowed the Kings Bench to rule on the whole of the case.
