遗嘱是被继承人在生前所为,死亡时发生效力的无相对人之单独行为。一般而言,遗嘱可能的内容包含了指定应继分和遗赠等事项。

遗嘱必须是具备遗嘱能力之人所为,符合法定要式者,才是一个在法律上有效的遗嘱。得为遗嘱的能力称为遗嘱能力,比如根据中华民国民法第1186条的规定,16岁以上且未受监护宣告之人才能为遗嘱。另外第1188条则规定法定遗嘱形式有下列5种:自书遗嘱、口授遗嘱、代笔遗嘱、密封遗嘱、公证遗嘱。

在香港,遗嘱的订立需要有至少两位非受益人(法人)担任见证人,遗嘱才具有法律效力。一般而言,这两位见证人的其中一位会由协助订立遗嘱的律师楼合伙人担任,而另一人则由前述律师所邀请的同业(一般由邻近律师楼的合伙人,但不能采用同一律师楼的其他合伙人)担任。
